General terms and conditions

GRAND HOTEL HRADEC s.r.o. - Vyhlídka establishment, with registered office at Bohdalecká 1490/25, Michle, 101 00 Prague 10, ID No.: 07024223, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 293251 (hereinafter referred to as "Hotel").

 

  • These Terms and Conditions govern the mutual rights and obligations arising in connection with or under a contract between the Hotel and another person.
  • These terms and conditions therefore apply generally to all hotel guests and agencies with whom there is no written service contract.

 

1. RESERVATION OF ACCOMMODATION AND SERVICES:

  • reservation of accommodation and other services in the hotel and confirmation of this reservation by the hotel is possible only in writing, i.e. by email
  • the reservation is considered valid and binding if the hotel confirms the reservation in writing (by email) or the guest receives an automatic email confirmation generated by the relevant online booking system
  • the booking is completed by credit card or by paying a deposit equal to the amount of the accommodation and services specified; individual conditions may also be set
  • if the hotel or the guest fails to comply with the conditions set out in point 3 of this article, the hotel may not provide the accommodation and services
  • the information provided on the booking confirmation is binding on both parties

 

2. PRICES, CANCELLATION AND PAYMENT TERMS:

  • the price is per room per night, including breakfast, unless the guest chooses otherwise
  • VAT of 12% is included in the price; the city tax of 1 EUR/person per night is not included in the price, this fee is payable at the hotel reception
  • cancellation of a confirmed reservation can also only be made in writing, i.e. by email; the exact method of cancellation is determined by the booking system used for the reservation
  • when cancelling a booking that has been made through an external provider (e.g. booking.com), the booking must also be cancelled through that provider in the manner required by that provider and subject to the booking conditions
  • a change of reservation, i.e. moving the booked services to another date, is considered a cancellation of the original reservation and is subject to the same regime as cancellation
  • accommodation can be paid in cash, where the hotel accepts CZK and EUR; in case of payment by credit/debit card the amount in EUR will be charged, if the client has a CZK account or other account, the amount in EUR will be charged by the client's bank conversion
  • according to the Act on sales registration, the seller is obliged to issue a receipt to the buyer; at the same time he is obliged to register the received sales with the tax administrator online, in case of technical failure within 48 hours at the latest
  • the hotel reserves the right to pre-authorise the guest's card up to the total amount of the accommodation
  • the hotel reserves the right to pre-bill the total amount of the accommodation to the guest's credit/debit card, if the conditions of the reservation so stipulate
  • in case of no-show on the reservation date, the reservation is cancelled and the hotel is entitled to charge the costs according to the cancellation conditions of the reservation

 

3. RIGHTS AND OBLIGATIONS OF THE GUEST:

  • the guest has the right to use the reserved areas and their facilities, as well as the facilities of the common areas
  • the guest is responsible for any damage caused to the room during the stay and agrees to pay for any repairs, replacements or special cleaning; the amount of the payment will be determined by the hotel
  • the guest is obliged to complain about any defects and shortcomings during his/her stay in the hotel so that a remedy can be arranged
  • the guest is obliged to pay the costs associated with the use of the hotel services, including additional services, on the day of departure at the latest, unless otherwise agreed; in the event of non-payment, the hotel is entitled to charge (charge) the corresponding amount to the guest's credit card after departure
  • the guest may withdraw from the contract on the basis of cancellation conditions or if the hotel has failed to provide the guest with the services agreed in advance, corresponding to the standard of the hotel
  • check-in time is from 15:00 on the day of arrival; earlier check-in is possible only by agreement with the hotel and at a charge
  • check-out time is until 11:00 on the day of departure; late check-out is possible by agreement with the hotel and for a fee
  • the entire hotel is non-smoking; violation of this regulation and smoking in the room or on the premises will entitle the hotel to charge the guest
  • a fine of EUR 200 for cleaning the room or hotel premises; the smoking ban and the associated fine also apply to smoking electronic cigarettes; smoking is only allowed outside the hotel in the designated area(s)
  • between 22:00 and 6:00 is the night time; behaviour that leads to disturbance of other guests during the night time is strictly prohibited (includes loud music, television, shouting in rooms, corridors and other disturbing behaviour); in case of serious violation of this rule, the hotel may penalize guests with a financial penalty of up to EUR 400 or, in necessary cases, call the police

 

4. RIGHTS AND OBLIGATIONS OF THE HOTEL:

  • the hotel is obliged to provide accommodation for the guest on the basis of pre-agreed services that correspond to the hotel's standard
  • if the hotel cannot accommodate the guest on the basis of a previously made and confirmed reservation, it is obliged to arrange adequate accommodation for the guest in another establishment

 

5. FINAL PROVISIONS:

  • these terms and conditions are valid from 25 June 2021 and the hotel reserves the right to change them and the guest is obliged to abide by these current terms and conditions
  • the hotel collects the guest's personal data only for the time necessary until the termination of the provision of the agreed services and does not provide this data to other persons
  • any disputes arising out of or in connection with the accommodation contract, the hotel and the guest agree to resolve amicably in the first instance. If any dispute arising out of or in connection with the accommodation contract cannot be resolved amicably between the hotel and the guest, the dispute shall be settled by the general court of the Czech Republic having jurisdiction in the matter and place; the Czech Trade Inspection Authority, with its registered office at Prague 2, Štěpánská 567/15, Postal Code 120 00, identification number 000 20 869, internet address: www.coi.cz, is competent for the out-of-court settlement of consumer disputes arising out of the accommodation contract.
  • the online dispute resolution platform located at http://ec.europa.eu/consumers/odr can be used to resolve disputes between a guest residing in another Member State of the European Union and a hotel under an online service contract
  • The European Consumer Centre Czech Republic, with its registered office at Prague 2, Štěpánská 567/15, Postcode 120 00, Internet address: www.evropskyspotrebitel.cz, is the contact point for online dispute resolution within the meaning of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes, and performs its functions within the meaning of this legislation only if the parties to the dispute do not have their habitual residence (registered office) in the same Member State of the European Union.

 

PRIVACY POLICY (GDPR)

Pursuant to Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter also referred to as "GDPR")

 

Dear guests, on this page you will find the most important information about your personal data processed by GRAND HOTEL HRADEC s.r.o. - Vyhlídka establishment in accordance with GDPR, ID No.: 070 24 223, with registered office at Bohdalecká 1490/25, Michle, 101 00 Prague 10, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 293251 (hereinafter referred to as the "Administrator" or the "Company").

The purpose of this notice is to inform you about the processing of personal data that occurs in connection with your visit to the www.omniahotel.cz website, as well as about certain other cases of processing of personal data where the Company's activities involve the processing of personal data of other persons (e.g. hotel guests, journalists, etc.; hereinafter referred to as "Data Subject").

Processing of personal data from contact forms

By sending an enquiry via the enquiry form, personal data is also collected, which is located in an encrypted interface and includes the following data:

  • the date and time the enquiry form was sent;
  • data from the submitted enquiry form;
  • any questions from the visitor.

The processing of these log files will be carried out by the Company itself.

Personal data about visitors to the Controller's website processed in connection with the administration of the Controller's website, or the administration of the Controller's booking system and/or the implementation of

internet marketing will only be processed provided that the relevant data subject has given consent to the processing in question within the meaning of Article 6(1)(a) GDPR, and for the period for which

the consent in question is valid. In the absence of the Data Subject's consent within the meaning of Article 6(1)(a) GDPR, the Data Subjects' personal data are/will be processed at the request of the Data Subject

within the meaning of Article 6(1)(b) GDPR.

Processing of personal data for sending the newsletter

 

In the case of a website user's interest in receiving newsletters and other promotional communications, the Company will process, on the basis of consent, the personal data provided by such user for these purposes, always at least to the extent of the e-mail address, name and surname. The content of the newsletter and other advertising communications may be personalised on the basis of the data provided and other data for the personalisation of the content which the Company obtains from the user's behaviour on the website or newsletter.

 

The Company will start processing the user's personal data only after the user has filled in the relevant form for ordering the newsletter and other advertising messages with his/her data and subsequently placed the order and confirmed his/her consent to the processing of personal data by replying as instructed in the received e-mail message. If the order is not confirmed, the completed data will not be stored anywhere.

 

The personal data provided are processed until the consent given is withdrawn. The actual processing of the personal data provided will be carried out by the Company itself or through a specialized processor.

 

Consent to this processing of personal data is entirely voluntary and may be withdrawn by the user at any time by sending a notice of withdrawal of consent in writing to the Company's registered office (see below).

 

 The user may also withdraw the consent given by clicking on the "You can unsubscribe" link in the newsletter or advertising message sent to him.

 

Processing of personal data in connection with photo documentation of events

 

For events organised by us, we take photo documentation (situational shots of events) to a reasonable extent for the purpose of subsequent publication of selected photos on our website for promotional purposes of the Omnia Hotel. In this way, we do not primarily depict the visitors of a specific event, but rather the overall atmosphere of the event, the images are not published in detailed resolution, nor do we attach descriptions of specific persons attending the event. According to the expert opinion of the Office for Personal Data Protection, in such cases, the primary issue is not the protection of personal data, but the protection of privacy under the Civil Code; therefore, consent to the processing of personal data for "illustrative" images is not required.

 

Visitors are warned in advance of the photographic documentation in the form of a camera pictogram, our photographers are visibly marked and photographic documentation is taken only in the main event area, so visitors always have the opportunity to stay in areas where photographic documentation is not taken. Processing of data on the basis of a reservation or stay

 

On the basis of your reservation (or stay without reservation), we process personal data of our clients to the following extent:

 

  • identification and contact details (name and surname, address of permanent residence, ID card number or similar document and, where applicable, e-mail address and telephone number);
  • in the case of natural persons engaged in business, also the name of the natural person engaged in business, registered office, registration number, VAT number, VAT payer;
  • in the case of business trips of non-business persons, also the details of the organisation that booked or paid for the stay);
  • information about the purpose of the stay, or information that the client is a person who is not subject to the spa or recreational stay fee;
  • information about your membership in the loyalty program;
  • details of your stay and the services you use and the amount and method of payment for the services provided (bank account number or credit card details in the case of non-cash payment);
  • in the case of foreign nationals, in addition to the above data, date of birth, nationality, travel document number, visa number, address of permanent residence abroad;
  • in the case of guests who use our hotel parking, also the license plate number of the car.

 

Processing for the purposes of compliance with legal obligations

 

The provision and processing of all of the above personal data, with the exception of your e-mail address and telephone number and information about your membership in the loyalty program, is necessary for the purpose of fulfilling the Company's legal obligations, in particular those arising from the Local Tax Act and the Act on the Residence of Foreigners in the Czech Republic, as well as from accounting and tax regulations.

 

Processing necessary for the performance of the contractual relationship

 

The processing of your identification data and data about your stay and the services provided and the amount and method of payment is necessary for the purpose of fulfilling the contractual relationship relating to your stay, i.e. securing orders and reservations, concluding and fulfilling contracts relating to the accommodation, catering and related services offered and provided by the Company.

 

Processing necessary for the purposes of legitimate interest

 

We process your personal data in the scope of your name, surname, e-mail address and information about your residence on the basis of the legitimate interest of the Company for the purpose of direct marketing, the purpose of processing is exclusively the possibility of sending you marketing and business communications, i.e. information about interesting news, discounts, etc.

 

We also process personal data to the same extent for sending satisfaction questionnaires after your stay in order to verify your satisfaction with the Company's services and to continuously improve the quality of the Company's services for you.

 

There are no cases of our guests questioning the services provided by the hotel. If there is a case of a dispute about the services provided by the Company, the Company would be obliged to process data about the services provided to the extent necessary to conduct such a dispute, solely for the purpose of protecting the Company's rights in such a dispute. Similarly, the Company would also be obliged to process the necessary data in the event of non-payment for services or in the event of damage caused to the Company.

 

Automated processing of your data

 

In no case do we carry out automated decision-making or other automated processing of your personal data that would have legal effects for you or would affect you significantly in a similar way.

 

Processing of personal data in connection with the handling of inquiries related to accommodation services on the website.

 

In the case of a request for services on the Omnia Hotel website www.omniahotel.cz via the enquiry form or by sending an enquiry to the relevant email listed on the website, the Company will process the potential customer's personal data, including name, surname, email address, telephone contact, or company only on the basis of your consent. You can withdraw your consent at any time by sending an explicit communication to hotel@omniahotel.cz.

 

After processing the relevant enquiry, the Company may use the aforementioned data on the basis of your consent for its marketing purposes relating to its offer of accommodation services. In this case, the data subject has the right to withdraw the consent given at any time by sending an explicit communication to hotel@omniahotel.cz.

 

The processing of the personal data provided will be carried out by the Company itself, or through a processor, the Processor.

 

Processing of personal data in connection with the accommodation service

 

The personal data of customers (name, surname, date of birth, ID card or passport number, residence, signature), who make their stay in Omnia Hotel, are processed by the Company on the basis of the legal grounds imposed by Act No. 565/1990 Coll., on local fees (§3g), as amended, and Act No. 326/1999 Coll., on the residence of foreigners (§101), as amended. Therefore, this is processing necessary to comply with a legal obligation in accordance with Article 6(1)(c) GDPR and such processing does not require the consent of the accommodated person (Data Subject).

 

The Company stores the name, surname and email address of its customers on the basis of consent, also for the purpose of verifying customer satisfaction or a commercial offer of the same nature or service that was the subject of the order. In this case, the Data Subject has the right to withdraw the consent given at any time by sending an explicit communication to hotel@omniahotel.cz.

 

The feedback will be collected by the Company and thus the e-mail addresses of the customers will be processed by sending a questionnaire on satisfaction with the stay at the Omnia Hotel, i.e. a commercial communication, to these e-mail addresses, as stated above.

 

The questionnaire will only be sent to customers once in connection with the respective purchase of the service. The company will carry out the feedback and thus the processing of the

customers' e-mail addresses itself or through a contractually obliged third party (processor).

 

Google Analytics and Google Adwords

 

The Company uses Google Analytics, a service developed and operated by Google Inc., having its registered office at Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"), to analyse the website using cookies.

 

Google will not transfer data, incl. IP-addresses with other data. Google's privacy statement can be viewed here.

 

The visitor to the website can prevent the collection of cookies and their analysis by Google Analytics by changing the browser settings as described above and by clicking on the following link, which will place an opt-out cookie on the computer to prevent the future storage of data about the visit to the website.

 

By installing the browser plugin available here. This plugin only works in the respective browser on the respective computer and must not be deactivated or deleted after installation in order to preserve the deactivation of Google Analytics.

 

Within Google Analytics, the Company also uses related advertising features provided by Google, such as Google Ad Network impression reports, enhanced reporting of anonymous demographic data (e.g., age, gender, interests), or displaying ads in the content network based on product views (remarketing), including Google AdWords for personalizing advertising and improving ad targeting and remarketing.

 

Information text about the camera system in the Vyhlídka Hotel

 

The purpose of the processing is to protect property and increase personal security. The scope of the processing includes only the image recording of the camera system, without sound recording. The controller of these records is the Company. The CCTV footage is stored on a HDD device/hard drive operated by the Company and no other processor is used for this CCTV footage. The place of processing is Residence Vyhlídka and its premises at Černohorská 151, 542 25 Janské lázně, Czech Republic.

 

Only law enforcement authorities or administrative authorities for the purposes of misdemeanour proceedings may receive data from the CCTV system.

 

Cameras cover the entrance and reception areas, corridor areas, staff entrances, supply and handling areas, terraces, fitness/wellness entrances, lobbies/foyers, access to conference facilities, ramp, courtyard/interior.

 

The maximum retention time is 72 hours, after which the data is automatically deleted by overwriting it with a new recording, as the camera system is based on a loop mode.

 

The operation of the cameras is continuous (or based on an automatic motion sensor).

Period of processing of personal data

We process your personal data for the duration of your stay in our hotel. Subsequently, after its termination, we process only:

 

Data for which we are obliged to process under the relevant legal regulations, and only for the time necessary under these legal regulations (e.g. the accounting and tax documents we issue to you also contain some of your personal data (name and surname, type of service provided, date of issue of the document). We keep these documents only for the purpose of complying with the obligations set out in the relevant accounting and tax legislation, for the period of time imposed by such legislation.)

 

Your name, surname, e-mail address and information about your stay for the purpose of direct marketing of the hotel (sending information about interesting news or discounts on our services, etc.) and for sending satisfaction surveys. We only process the data for sending satisfaction surveys until the surveys have been evaluated (maximum 1 month after your stay). For the purpose of direct marketing,

 

we process your data as mentioned above until you inform us of your possible objection to further such processing.

 

Data necessary for the purposes of existing or imminent litigation. We process this data only until the dispute has been finally resolved and the obligations arising from the decision have been fulfilled, or until such time as disputes may arise under applicable law in relation to the services provided.

 

After the above periods, we regularly dispose of your personal data, both in paper and electronic form.

 

Other data protection rights

 

Data subjects whose personal data is processed by the Company are entitled to the following rights related to the processing of their personal data, provided that the conditions set out in the legislation are met:

 

  • the right of access to personal data, consisting of the right to receive it free of charge on request
  • information about which of their personal data is processed by the Company;
  • the right to have their personal data processed corrected;
  • the right to have their personal data processed erased;
  • the right to restrict the processing of their personal data;
  • the right to data portability;
  • the right to withdraw consent to the processing of personal data at any time, if consent is a legal
  • the basis for the respective processing of personal data (i.e. for sending the newsletter and other advertising
  • communication).

 

Data subjects whose personal data are processed by the Company also have the right, subject to the fulfilment of the conditions set out in the legislation, to object to the processing of their personal data if the legal basis for the processing is the legitimate interests of the Company. If personal data are processed for direct marketing purposes, the data subject has the right to object to such processing at any time. The data subjects whose personal data is processed by the Company may exercise the above rights in writing or by e-mail to the Company as the data controller, using the contacts listed below.

The aforementioned rights of the data subject are not absolute rights. The Company will assess the rights exercised individually and with regard to its own rights or the rights of third parties.

If the Data Subject believes that there has been a breach of the law in relation to the protection of his or her personal data, he or she has the right to lodge a complaint with a supervisory authority. The supervisory authority for the territory of the Czech Republic is the Office for Personal Data Protection Pplk. Sochora 27,170 00 Prague 7 (www.uoou.cz).
